Un tema central que permea los ensayos de este volumen es precisamente que la igualdad legal no elimina el trato discriminatorio de los sujetos indígenas. Por el contrario, la igualdad ante la ley promueve y legitima la discriminación. La igualdad legal genera discriminación al dar un trato de iguales a personas desigualmente ubicadas. Al hacer caso omiso de las desigualdades existentes, el sistema legal no sólo deja de actuar para disminuirlas sino que de hecho las exacerba otorgando ventajas a los más privilegiados.
